Governments move from promises to enforcement

Artificial intelligence is no longer a lightly regulated frontier. Policymakers on both sides of the Atlantic have shifted from broad principles to concrete rules, pushing companies to rethink how they build and deploy AI. The thrust is clear: more testing, more transparency, and more accountability. As one tech chief executive told U.S. senators in 2023, “We think that regulatory intervention by governments will be critical to mitigate the risks of increasingly powerful models.” That warning, delivered by OpenAI’s Sam Altman, now reads less like a plea and more like a roadmap.

What the new wave of rules demands

Across jurisdictions, the requirements differ in detail but rhyme in intent. Regulators want trustworthy systems that are safe and understandable, and that respect rights. In practice, that means new obligations for model developers, app builders, and deploying organizations.

  • Risk management: Firms must identify and mitigate risks across the AI lifecycle. The U.S. National Institute of Standards and Technology promotes a framework for “trustworthy AI” that is “valid and reliable” and “secure and resilient.”
  • Transparency: Users should be told when they are interacting with AI. Systems that generate media may need labels or metadata indicating synthetic origin.
  • Testing and oversight: Pre-deployment evaluations, bias testing, and post-deployment monitoring are becoming standard expectations, often paired with human oversight requirements.
  • Documentation: Model cards, data provenance disclosures, and logs are moving from research best practices to compliance artifacts.

Europe’s risk-based law sets the pace

The European Union’s AI Act, finalized in 2024 after years of debate, takes a “risk-based approach”. The law places stricter requirements on systems used in areas like employment, education, credit, and critical infrastructure, where errors can cause harm. It prohibits uses considered unacceptable, such as social scoring by public authorities, and it sets baseline transparency rules for generative AI, including disclosures for AI-generated media.

Under the act, providers of high-risk systems will need to conduct conformity assessments, keep technical documentation, ensure data quality, and enable human oversight. The EU’s approach is phased, giving companies time to adjust. But the clock is ticking for firms operating in or selling to the bloc. Consultancies report a wave of compliance programs as companies map where their products may fall into high-risk categories and how to implement controls across engineering, legal, and product teams.

Washington adopts a whole-of-government posture

In the United States, a patchwork is tightening. The White House issued an Executive Order on the Safe, Secure, and Trustworthy Development and Use of Artificial Intelligence in late 2023, directing agencies to set testing standards, guard against chemical and cyber misuse, and support privacy-preserving techniques. The Office of Management and Budget followed with binding guidance in 2024 that requires federal agencies to inventory their AI systems, conduct impact assessments for uses affecting rights or safety, and adopt safeguards before deploying them.

While Congress has yet to pass comprehensive AI legislation, sectoral regulators have signaled that existing laws apply. The Federal Trade Commission has warned that claims about AI capabilities must be truthful and that unfair or discriminatory outcomes can trigger enforcement. In finance and healthcare, existing risk and safety regimes already offer hooks for oversight of AI-enabled products.

UK, China, and global coordination efforts

The United Kingdom has opted for a “pro-innovation” model that empowers existing regulators rather than creating a single new AI watchdog. It convened the 2023 AI Safety Summit, where countries and companies endorsed the Bletchley Declaration recognizing both the opportunities and the “significant risks” from so-called frontier AI. China, meanwhile, has moved quickly with rules for recommendation algorithms and deep synthesis, requiring providers to label synthetic media and verify real identities of certain users.

International bodies continue to set soft-law benchmarks. The OECD’s principles, first adopted in 2019, call for “human-centered and trustworthy AI.” Standards groups are also active: work on watermarking, model evaluation, and safety benchmarks is accelerating at organizations such as ISO/IEC and through public-private collaborations.

Industry rushes to show provenance and safety

In response, technology companies are expanding safety engineering and provenance tooling. Several major platforms support content provenance standards like C2PA, which attach tamper-evident metadata—often branded as Content Credentials—to AI-generated images. Others deploy watermarking or detection tools to identify synthetic audio and video. Model developers are publishing more detailed system cards, documenting training data sources and known limitations. Red-teaming—stress-testing models for dangerous behaviors—has evolved from a niche exercise to a formal program tied to release gates.

These steps reflect both regulatory pressure and market demand. Enterprises adopting generative AI want assurances about data protection, bias, and intellectual property. Insurers and auditors are asking for evidence of controls. Procurement teams are writing AI clauses into contracts. As one compliance officer at a European bank put it privately, the question inside organizations has shifted from “Should we do this?” to “Show me the paper trail.”

Supporters and skeptics find middle ground

Advocates of the new rules argue that basic guardrails are overdue. Civil society groups have long highlighted risks to privacy, fairness, and labor. Researchers, too, have warned about scaling harms. Geoffrey Hinton, a pioneer in the field, told The New York Times in 2023, “I console myself with the normal excuse: if I hadn’t done it, somebody else would have,” underscoring mounting unease from insiders about unintended consequences.

Industry voices, while largely accepting the direction of travel, warn about compliance burden and the risk of locking in incumbents. Startups say clarity helps, but they fear ambiguity around what qualifies as high-risk and how small firms can meet reporting obligations. Open-source communities are pressing for rules that do not equate openness with irresponsibility, noting the benefits of transparency for security and research.

What changes now for organizations

  • Map your AI: Maintain an inventory of systems, their purposes, data sources, and risk levels. Many emerging rules hinge on knowing where AI shows up in products and operations.
  • Build controls into the pipeline: Integrate bias testing, security reviews, and human-in-the-loop checks into model and product development.
  • Document, then document more: Keep audit-ready records—model cards, data lineage notes, and decision logs—to demonstrate due diligence.
  • Explain and label: Provide clear user disclosures for AI features. If generating media, attach provenance metadata where feasible.
  • Watch the standards: Align internal practices with evolving guidance from NIST, ISO/IEC, and sector regulators to stay ahead of formal requirements.

The age of voluntary pledges is giving way to enforceable obligations. Europe’s law will shape global product design, even for firms based elsewhere. U.S. agencies are operationalizing risk management in public procurement and oversight. Other capitals are not far behind. The regulatory mosaic is complex, but its message is simple: prove your systems are safe, fair, and understandable.
