Governments and major technology companies are moving quickly to make artificial intelligence more transparent. New rules in Europe, policy steps in the United States, and industry standards for digital watermarks aim to show when content was made by AI. Supporters say this will help fight deepfakes and restore trust online. Critics warn the tools are imperfect and could create new risks if used poorly.

The new rules: Europe leads, U.S. sets guidance

In 2024, the European Union adopted the AI Act, which it has described as the world’s first comprehensive AI law. The law takes a risk-based approach and sets transparency duties for AI systems that generate or manipulate content. Providers must disclose when a user is seeing AI-generated images, audio, or video. Some high-risk applications face strict controls. Certain practices, such as social scoring by public authorities, are prohibited.

Industry shifts: Watermarks, labels, and provenance trails

Tech firms are rolling out tools to show how content was made and when AI was used. Two approaches are taking hold. One embeds signals in the media itself. The other records a provenance trail that travels with the file as metadata.

  • Invisible watermarks: Some research labs embed signals that are hard to spot but detectable by automated tools. Google DeepMind has promoted such methods with its SynthID projects for images and audio.
  • Content credentials: The C2PA standard, backed by media and tech companies, adds tamper-evident metadata, sometimes called Content Credentials. It can record which tool created an image, who edited it, and whether AI was used.
  • Platform labels: Social networks and video sites have begun labeling AI-made or AI-edited posts. Some require uploaders to self-disclose when they use AI to generate or alter media.
  • Creative tools: Image and video editors are adding provenance features by default so exported files carry a trail of how they were made.

These steps come as synthetic media becomes easier to produce. High-quality voice cloning and image generation can be done with basic hardware and public tools. That has raised fears of deceptive content during elections and crises.

Why it matters: Elections, fraud, and public trust

In early 2024, an AI-generated robocall that mimicked the U.S. president urged voters to skip a primary election in New Hampshire. State officials said it was unlawful and moved to track its source. The incident illustrated the stakes. A small group with modest resources can now create persuasive fake audio that spreads fast.

Similar threats exist for faked images and videos. Financial scams increasingly use cloned voices to request urgent transfers. Celebrity deepfakes appear in ads without consent. Newsrooms must sort real footage from fabricated clips. Clear labeling and better provenance tools could help the public and professionals tell the difference.

Proponents say the new rules and standards will set clearer expectations. The European Commission has called the AI Act ‘the world’s first comprehensive AI law,’ and said its risk-based design aims to protect citizens while allowing innovation. In the U.S., policymakers want standards that are flexible but effective, especially for critical sectors and federal use.

Limits and open questions

Experts caution that labeling and watermarking are useful, but limited. In some cases, compression, cropping, or re-recording can degrade or remove watermarks. Metadata can be stripped when files are uploaded or shared across platforms. Not all generative tools will follow the same standards. Bad actors can use unmarked models on private servers.

  • Detection is not decisive: Watermarks can fail, and detection is probabilistic. Security researchers often say watermarking is ‘not a silver bullet’.
  • Provenance gaps: If a single tool in a workflow does not add metadata, the trail can break. That weakens the value of provenance chains.

There is also a policy challenge. Labels need to mean something. If users see them everywhere, they may tune them out. If labels are rare, people may assume anything unlabeled is genuine, which may not be true. Policymakers will need to set clear thresholds for when disclosure is required and how it should appear.

How the new regime could work in practice

Newsrooms, platforms, and creative industries are testing workflows that combine several tools. A typical pipeline might look like this:

  • AI tools embed an invisible watermark and attach a Content Credential with key facts.
  • Editing software preserves the credential as assets are cropped or color-corrected.
  • Publishing systems check the credential and display a plain-language label to readers.
  • Platforms scan uploads for watermarks and metadata. If none is found, they prompt uploaders to disclose AI use, or they add a contextual note.

Clear, consistent user interfaces matter. Labels should be prominent but not alarming, and they should link to more detail. That helps users verify content without overwhelming them.

What to watch next

The EU will phase in its AI Act obligations over the next two years, starting with bans on certain practices and moving to full compliance for high-risk systems. Companies that build or deploy general-purpose models will face new transparency duties. In the U.S., agencies are expected to publish more guidance on testing and on authenticating digital content, including how federal agencies should label AI-generated material.

Industry groups will continue to refine technical standards. Broader adoption of C2PA and compatible watermarking could make provenance more reliable across the web. Civil society organizations will press for safeguards to ensure labeling does not become a tool for censorship or surveillance.

The goal is simple to state and hard to deliver: help people know what to trust online. The push for transparency will not end the misuse of AI. But clearer rules, better tools, and honest labels can make deception harder and accountability stronger.
