EU’s AI Act Moves From Paper to Practice

Europes landmark Artificial Intelligence Act is entering a decisive phase. After the law took effect in 2024, the first sets of obligations and bans begin to bite in 2025. Companies that build, buy, or deploy AI in the European Union are racing to adjust. Regulators say the goal is simple: make AI safer without throttling innovation. The reality is more complex, and the stakes are global.
What the law does
The EU AI Act uses a risk-based approach. It sorts AI systems into categories and applies rules in proportion to potential harm. The strictest limits hit uses that policymakers view as a threat to fundamental rights.
- Unacceptable risk: Outright bans apply to practices such as social scoring by public authorities and mass scraping of facial images for databases. Some forms of real-time remote biometric identification in public spaces face near-bans, with narrow law-enforcement exceptions.

Large general-purpose AI models get special attention. Very capable models that could create systemic risks face extra testing, reporting, and security obligations. Providers of all general-purpose models must share technical information with downstream developers and comply with copyright rules, including respecting opt-outs for training data where applicable.
Penalties are significant. Fines can reach up to the higher of 625 million or 7% of a companys global annual turnover, depending on the breach. National supervisory authorities will enforce the rules, coordinated by a new EU-level AI Office.
Why now, and why it matters
The AI Act was first proposed in 2021. It was politically agreed in late 2023, approved in 2024, and entered into force that summer. Obligations phase in over several years. Some bans and transparency duties apply sooner, while comprehensive high-risk requirements arrive later as standards and technical guidance mature.

Industry reaction
Developers and corporate buyers see both risk and opportunity. Some worry about compliance burdens, especially for startups and open-source projects. Others say clear rules will unlock investment by reducing uncertainty.
Sam Altman, chief executive of OpenAI, told U.S. lawmakers in 2023 that 22regulatory intervention by governments will be critical to mitigate the risks of increasingly powerful models.22 Many industry leaders now strike a similar tone in Europe, urging predictable enforcement and workable technical standards.
Chipmakers and cloud providers, buoyed by a boom in AI demand, say the direction is set. At a 2024 developer conference, Nvidias Jensen Huang called the moment 22the next industrial revolution.22 If he is right, rules that channel that momentum will shape where capital, talent, and data flow.
What companies should do now
Lawyers and auditors say the first year of implementation is about mapping risk and documenting control. The practical steps look familiar to anyone who lived through the early GDPR period.
- Inventory your AI: Identify models and tools across the business, including shadow IT and vendor-supplied systems.
- Classify risk: Map each use case to the Acts categories and check if any fall into high-risk domains.
- Harden data governance: Verify training and testing data are relevant, representative, and managed to reduce bias. Track data provenance and rights.
- Document and test: Keep technical documentation, performance metrics, and logs. Conduct pre-deployment testing and ongoing monitoring.
- Enable human oversight: Define who can override AI outputs and how that works in practice.
- Contract with vendors: Update supplier terms to secure access to model cards, risk assessments, and incident reporting.
- Label AI content: Ensure chatbots identify themselves and that synthetic media is disclosed where required.
- Plan for incidents: Set up processes to detect, report, and remediate serious AI malfunctions or security issues.
Small and medium-sized enterprises face a heavier relative lift. EU policymakers promised support through sandboxes and guidance. The law also includes some relief for open-source developers, though obligations rise when models are embedded in high-risk uses or reach systemic scale.
How this fits globally
The EU is not alone. The United States issued an executive order in 2023 directing agencies to advance AI safety, civil rights, and competition, and encouraging the use of voluntary standards. The National Institute of Standards and Technology published an AI Risk Management Framework to help organizations translate principles into practice. The United Kingdom convened an AI Safety Summit in 2023 that produced the Bletchley Declaration, with governments and companies pledging to cooperate on frontier risks. In 2024, the United Nations General Assembly adopted a nonbinding resolution urging safe, trustworthy AI worldwide.
These initiatives differ in approach. The EU sets detailed obligations in law. The U.S. leans on sectoral rules and guidance. The U.K. favors coordination through existing regulators. But they are converging on several ideas: transparency, accountability, testing and evaluation, and respect for rights.
Unanswered questions
Key details will depend on technical standards and guidance still being developed. European standards bodies are drafting harmonized standards that companies can follow to presume compliance. Codes of practice for general-purpose AI are also in progress. National authorities are staffing up and building expertise to supervise a fast-moving field.
Civil society groups will watch how the bans are enforced and whether high-risk systems meaningfully reduce bias and error. Industry will look for legal certainty and international alignment. Courts will play a role, too, as disputes over scope and penalties emerge.
