A turning point for AI governance

After years of rapid advances in artificial intelligence, a clearer rulebook is emerging. Governments and standards bodies are moving from principles to practice. Companies are now racing to adapt. The shift is transforming how AI is built, tested and deployed. It also raises new questions about innovation, competition and accountability.

Policymakers say the goal is balance. The White House’s 2023 executive order states, “Artificial intelligence (AI) holds extraordinary potential for both promise and peril.” The message is echoed in Europe and across the G7. Regulators want to capture benefits while reducing risks. Industry leaders, meanwhile, are setting up guardrails of their own. They say predictable rules are better than uncertainty.

What the new rules say

The most comprehensive law to date is the European Union’s AI Act, finalized in 2024. It takes a risk-based approach. The higher the risk to safety or rights, the tighter the obligations. The law restricts certain applications and sets duties for providers and deployers of high-risk systems. It also introduces tailored provisions for general-purpose AI.

  • EU AI Act: Classifies systems by risk level. Prohibits some uses viewed as unacceptable. Requires risk management, data governance, documentation, human oversight and post-market monitoring for high-risk AI. Includes transparency duties for certain AI that interacts with people or generates content.
  • United States: A 2023 executive order directs agencies to advance safety testing, security, consumer protection and worker rights. It tasks NIST with evaluations for advanced models and promotes watermarking research. The NIST AI Risk Management Framework, released in 2023, offers a voluntary blueprint for “trustworthy” AI.
  • International standards: ISO/IEC 42001, published in 2023, sets a management-system standard for organizations that design or use AI. It mirrors well-known approaches in cybersecurity and quality management, but tailored to AI risks.
  • Multilateral efforts: The G7’s Hiroshima Process produced guiding principles and a code of conduct for advanced AI in 2023. The UK convened a global safety summit at Bletchley Park that same year, focusing on evaluation and frontier risks.

Enforcement will vary. In the EU, obligations phase in over time. In the U.S., existing laws still apply. The Federal Trade Commission has warned companies not to overstate AI claims. As the agency put it, “There’s no AI exemption to the FTC Act.” Consumer protection, anti-discrimination and privacy rules remain in force.

How companies are responding

The new landscape is pushing organizations to formalize AI governance. Legal, security and product teams are working together more closely. Boards are asking tougher questions. Vendors are being vetted with new criteria. Many firms are training staff on responsible AI.

  • Model governance: Companies are cataloging AI systems, assigning risk levels and documenting intended use. They are introducing approval gates and change controls for models in production.
  • Evaluation and testing: Teams are stress-testing models for harmful content, bias and robustness. Red-teaming and adversarial testing are becoming routine, especially for generative AI.
  • Data and provenance: Organizations are tightening data sourcing and consent checks. Interest is growing in content provenance standards such as C2PA metadata and other labeling tools, though technical limits remain.
  • Security: Secure-by-design practices are extending to AI pipelines. That includes monitoring for model drift, prompt injection and data leakage. Many are mapping practices to NIST and ISO guidelines.
  • Human oversight: High-stakes uses—like hiring, lending or healthcare—are adding human review and audit trails. Decision-support rather than full automation is common in early deployments.
  • Vendor risk: Contracts now include clearer terms on training data, IP, incident reporting and liability. Buyers are asking for documentation, evaluation results and compliance attestations.

Some leaders have offered candid assessments of the trade-offs. OpenAI chief executive Sam Altman told ABC News in 2023 that “people should be happy that we are a little bit scared of this.” Developers say caution is justified, but warn that heavy burdens on smaller firms could slow competition.

Supporters and skeptics

Supporters argue the rules are overdue. They say consistent requirements will raise the floor on safety and trust. They also believe legal clarity will make investment easier. Policymakers have signaled flexibility, including sandboxes and support for startups. Standards bodies are offering practical templates for compliance.

Skeptics warn of unintended effects. They worry that complex rules will favor the largest companies, which can absorb compliance costs. Open-source advocates fear that broad obligations on general-purpose models could chill research and community-driven innovation. Civil society groups, meanwhile, urge a sharper focus on surveillance and labor impacts.

Experts also caution against overreliance on technical fixes. Watermarking and provenance tools can help, but they are not foolproof. Attribution can break when content is compressed or edited. Detection is a cat-and-mouse game. As one researcher put it at recent forums, watermarking is a signal, not a shield.

What it means for people

For consumers, the changes may show up as more labels and disclosures. Some chatbots already explain that users are interacting with AI. More services are experimenting with content credentials. Expect clearer opt-outs and complaint channels.

For workers, the impact will vary by sector. Productivity tools are spreading in offices, software development and customer service. That could change task mixes and training needs. Labor groups are watching closely for job displacement and monitoring. Regulators say existing workplace protections apply to AI-enabled tools.

Healthcare, finance and public services will likely move cautiously. These sectors face stricter rules and higher expectations. The pattern so far: pilot projects, tight oversight, independent evaluation and staged rollouts. Many deployments keep a human in the loop, especially where safety or rights are at stake.

The road ahead

Several issues remain unresolved. Measuring “systemic risk” for general-purpose models is still an open question. So is how to audit complex systems without exposing confidential data. International coordination will be tested as rules diverge or overlap. Advocates for low- and middle-income countries warn against a regulatory gap that could leave them with fewer benefits and more risks.

  • Standards maturation: Expect updates to NIST guidance and related profiles for different sectors. ISO committees will refine management and auditing standards as experience grows.
  • Evaluation tools: Independent testing labs and shared benchmarks are expanding. The push is toward reproducible, domain-specific tests rather than single “trust scores.”
  • Transparency practices: Documentation, incident reporting and dataset disclosures are likely to become more standardized, especially for high-risk uses.
  • Enforcement: Early cases will set precedents. Outcomes will clarify what counts as adequate testing, oversight and disclosure in practice.

The big picture is a shift from aspiration to accountability. The rules are only part of the story. Implementation—inside companies and across supply chains—will determine whether AI delivers value without causing harm. As regulators remind the market, basic laws still apply. And as the executive order warned, AI brings “promise and peril” in equal measure. The question now is how quickly institutions can turn principles into everyday practice.
