A new rulebook for AI

Europe now has a binding framework to govern artificial intelligence. The European Union’s Artificial Intelligence Act entered into force in 2024. It is the first comprehensive attempt by a major regulator to set common rules for how AI is built and used. The European Commission calls it “the first comprehensive AI law in the world.” Supporters say it brings clarity. Critics say the details will matter in practice. Both agree it will have a global reach.

The law takes a risk-based approach. It sets strict obligations for high-risk uses. It bans a short list of practices seen as unacceptable. It also adds transparency rules for systems that interact with the public. What the law covers

  • Transparency duties: Users should be informed when they interact with an AI system unless it is obvious. Synthetic media, often called deepfakes, must be labeled to reduce the risk of deception.
  • Penalties: Fines scale with the severity of the breach. For the most serious violations, penalties can reach a significant share of a company’s global turnover.

The law will apply in phases. Bans on prohibited practices take effect first. Transparency duties follow. High-risk requirements and many obligations for general-purpose systems arrive after a longer transition. This gives developers and users time to adapt.

Why it matters beyond Europe

Europe is a large market. Global firms that sell AI into the EU will likely align products and processes with the Act. That could set de facto standards elsewhere. It also adds to a patchwork of rules emerging around the world. In the United States, a 2023 Executive Order directed agencies to advance safe, secure, and trustworthy AI and tasked the National Institute of Standards and Technology (NIST) to expand guidance. The United Kingdom has so far favored a light-touch, sector-led approach. The G7 has promoted voluntary codes through the Hiroshima process. The OECD adopted cross-border principles in 2019 that many countries cite today.

The OECD principles say, “AI should benefit people and the planet by driving inclusive growth, sustainable development and well-being.” Europe’s law attempts to turn that broad goal into enforceable rules. The outcome will shape how companies handle data, test models, and disclose capabilities.

Supporters and critics

Consumer groups and many academics have pushed for firm guardrails. They point to risks from biased algorithms, opaque decision-making, and the rapid spread of generative tools. They argue that clear obligations will build trust. They also note that the Act includes a mechanism to update rules as technology changes.

Industry voices have urged proportionality and clarity. Startups worry about compliance costs, especially around documentation and testing. Larger vendors are concerned about overlapping rules across markets. Some civil society groups wanted broader bans, for example on most real-time biometric identification in public spaces. Others say enforcement capacity and technical expertise at national agencies will be the real test.

In a briefing, the European Commission described the Act as “future-proof” and focused on outcomes rather than specific techniques. It says the law aims to protect fundamental rights while supporting innovation. The Commission stresses that small and medium-sized enterprises will receive guidance and sandboxes to help them comply.

How enforcement will work

Each EU country will name a national supervisory authority. They will coordinate with the Commission’s AI Office. The AI Office will oversee general-purpose models and foster common practices on testing and evaluation. Market surveillance authorities will check products and services. Courts will still decide disputes and penalties.

Regulators will rely on conformity assessments for many high-risk systems. Providers must show they have risk management, high-quality data, human oversight, and robust logging. They must monitor systems after deployment and report serious incidents. Users of high-risk AI, such as employers or hospitals, also have duties. They must inform people when AI is used in decisions that affect them, keep records, and ensure trained staff supervise the systems.

NIST says its guidance helps organizations “manage the risks of AI systems” across the lifecycle. Industry groups and research labs already use it to structure internal controls, red-teaming, and model reporting.

Standards organizations are moving fast. ISO and IEC committees are drafting methods for testing robustness, transparency, and bias. These standards are likely to underpin EU conformity assessments. That could reduce fragmentation by giving developers a single set of technical targets.
