Europe’s sweeping AI law enters a new phase
Europe’s landmark Artificial Intelligence Act is moving from text to practice, setting a template that is already reshaping how companies build and deploy AI. The law, approved by the European Parliament in 2024 and finalized later that year, takes a risk-based approach and phases in requirements over the next two years. Lawmakers hailed it as “the world’s first comprehensive AI law”, designed to protect fundamental rights while supporting innovation.
Technology firms, from large platforms to startups, are now assembling compliance teams, auditing data pipelines, and documenting models. Legal and policy experts say the EU’s move will influence rulemaking beyond Europe, much as the GDPR did for data privacy.
What the AI Act requires
The regulation classifies AI systems by risk and sets obligations accordingly. The core elements include:
- Prohibited practices: Certain uses are banned outright, including manipulative or exploitative systems and “social scoring” by public authorities.

Timelines and the compliance clock
The AI Act does not arrive all at once. It enters into force after publication in the EU’s Official Journal, followed by staged application. Prohibitions take effect first, with transparency obligations and GPAI requirements following. The heaviest obligations for high-risk systems come later, allowing time for standards to mature. Industry groups expect 2025 to be a year of readiness assessments, with the bulk of high-risk conformity work cresting into 2026.
Technical standards bodies are filling in details. European standards organizations are drafting harmonized standards for data governance, testing, and monitoring. In parallel, international frameworks are offering practical guidance. The U.S. National Institute of Standards and Technology’s AI Risk Management Framework organizes governance into four functions — “Govern,” “Map,” “Measure,” “Manage” — that many compliance teams are adopting as a process blueprint.
Why this matters beyond Europe
Even companies with no EU headquarters may be covered if they sell or deploy AI in the bloc. For global vendors, the simplest path is often to apply EU-grade controls worldwide. Legal scholars note that GDPR triggered similar shifts as firms standardized their privacy programs.
Other jurisdictions are also moving. The G7’s Hiroshima AI process has urged responsible AI practices; the U.K. favors a sector-based, “pro-innovation” approach; the U.S. is leaning on procurement rules, safety testing, and existing laws. While the models differ, there is growing convergence on transparency, safety evaluation, and accountability. This alignment could reduce fragmentation for developers — if definitions and testing norms remain compatible.
Industry response: Opportunity and cost
Technology companies are broadly supportive of clear rules but differ on details. Providers of enterprise AI say customers are asking for documented model behavior, audit logs, and security assurances. Startups worry about administrative load. Open-source communities seek clarity on whether publishing model weights triggers high-risk obligations when downstream users build domain-specific tools.
Researchers also urge caution about overconfidence in current systems. A widely cited 2021 paper from linguists and computer scientists warned that large language models can function as “stochastic parrots”, producing fluent output without real understanding. The authors argued for rigorous evaluation and responsible scaling — concerns mirrored in regulatory requirements for testing, robustness, and human oversight.
At the same time, many in industry argue that well-written rules can spur adoption by building trust. A senior compliance advisor at a multinational bank said clients are more willing to pilot AI screenings for fraud and financial crime if the tools have clear documentation, performance metrics, and long-term monitoring plans. “Business leaders want guardrails, not guesswork,” he said.
What companies are doing now
Organizations preparing for the AI Act and adjacent guidance report several common workstreams:
- Model inventory and risk mapping: Cataloging all AI systems, their purposes, data sources, and user impacts; aligning them to risk tiers.
- Data governance upgrades: Improving data lineage, bias testing, and quality controls, especially for high-impact decisions in hiring, lending, and healthcare.
- Documentation and disclosure: Creating model cards, system logs, and user-facing notices; labeling AI-generated media to meet transparency duties.
- Evaluation and red-teaming: Stress-testing models for safety, security, and robustness; tracking performance drift over time.
- Human oversight plans: Defining when people can override or review AI decisions; ensuring escalation paths for errors and complaints.
- Vendor and open-source due diligence: Checking third-party components and licenses; verifying that upstream suppliers provide required artifacts.
Some firms are also adopting content provenance tools such as metadata-based watermarks and cryptographic signatures to help users identify AI-generated images, audio, and text. The aim is to deter deception without blocking creative or productive use.
Open questions and early tests
Important details remain under discussion. Experts say the definition of “systemic risk” for foundation models will be a flash point, as will thresholds tied to compute or capabilities. Developers want clarity on acceptable testing methods for frontier models without revealing sensitive weights or proprietary data. Civil society groups press for strong enforcement to protect rights and prevent surveillance misuse.
Regulators will also need resources. Supervisory authorities must handle technical audits and cross-border cases. Lessons from GDPR enforcement — including the value of cooperation among national regulators — are likely to apply. Transparency promises to be an early test case, as deepfakes and synthetic voices spread faster than labels and provenance checks can keep up.

The EU’s AI Act signals that the governance era for AI has arrived. Other governments are not standing still, and voluntary codes are becoming formal duties. For developers and deployers, the message is clear: build safety and transparency into products from the start.
